Allen Independent School District oversight campaign — library materials purchase, LSLAC composition, Public Information Act requests, and related findings.

  • Allen ISD sent a second clarification request invoking the Public Information Act’s same-day aggregation provision

    On June 5, 2026, a second clarification request was transmitted from Allen Independent School District (Allen ISD) covering six pending Public Information Act requests filed by LION on May 4, 2026 — ALLENISD-PIA-003 through ALLENISD-PIA-008. The transmission invoked Texas Government Code §552.261, subsection (e), the Texas Public Information Act’s (PIA — Texas Government Code Chapter 552) same-day aggregation provision. That provision lets a governmental body treat two or more requests received from the same requestor within one calendar day as a single request for purposes of calculating costs under Chapter 552. Section 552.261(e) is a cost-aggregation tool, not a clarification authority; clarification of requests is governed by a separate statute, §552.222. The June 5 transmission also re-invoked §552.222(b), the statute’s clarification-and-narrowing provision, which the district had first invoked on May 18.

    The June 5 transmission asked LION to clarify four points:

    1. The intent and scope of the severance LION had requested in its June 1 response.
    2. Whether the modified request was now limited to ALLENISD-PIA-003, PIA-005, PIA-006, and PIA-007.
    3. Whether ALLENISD-PIA-004 and PIA-008 should be considered withdrawn.
    4. Other points raised in LION’s June 1 response.

    A clarification request under §552.222 tolls the §552.221 production clock until the requestor responds. Under §552.222(d), if the requestor does not respond within 61 days of the clarification request, the underlying request is deemed withdrawn. Both clocks restarted with the June 5 transmission. The procedural consequence is that the production timeline for PIA-003 through PIA-008 is again indeterminate while the clarification cycle runs.

    The six requests at issue cover the Local School Library Advisory Council (LSLAC — the parent-majority committee required under Texas Education Code §33.025, enacted by Senate Bill 13 in 2025) selection process, LSLAC meeting records and recordings, internal communications referencing LION, and Library Media Services records relating to assembly of the district’s 818-title May 26 board-vote list. All six were originally filed on May 4, 2026, and have been in clarification posture since May 18.

  • LION filed a six-point objection and modification under Section 552.2615(b) of the Texas Government Code

    The Texas Public Information Act (PIA) — Texas Government Code Chapter 552 — gives Texas residents the right to request records from state and local government bodies, including school districts. When a governmental body believes producing those records will cost more than $40, it must send the requester a written cost estimate before charging anything. Texas Government Code §552.2615(b) then gives the requester ten business days to object in writing, modify the request, or accept the estimate — and if no response is sent in time, the request is treated as withdrawn.

    On May 27, 2026, Allen Independent School District (Allen ISD) sent LION a single aggregate cost estimate covering six open public-information requests: ALLENISD-PIA-003 through ALLENISD-PIA-008. On June 1, LION filed a written objection and statutory modification responding to that estimate.

    The six-point response did the following:

    1. Objected to the aggregate format and demanded an itemized per-request cost estimate for each of the six requests, so each one could be evaluated and paid on its own terms.
    2. Invoked Texas Government Code §552.234, which allows a requester to receive responsive records by electronic delivery when the records exist electronically — eliminating per-page copy charges for materials the District already holds in digital form.
    3. Requested severance under the PIA so that ALLENISD-PIA-003, ALLENISD-PIA-005, ALLENISD-PIA-007, ALLENISD-PIA-008, and the narrowed portion of ALLENISD-PIA-006 could be produced immediately, separately from any remaining disputed portion.
    4. Renewed LION’s prior fee-waiver request under Texas Government Code §552.267, which authorizes a governmental body to waive or reduce charges when releasing the information primarily benefits the general public.
    5. Reserved LION’s right to file an overcharge complaint with the Texas Attorney General (AG) under §552.2615 and Texas Administrative Code Title 1, §70.8, the rule governing complaints about charges that exceed what the statute and rules allow.
    6. Confirmed that under §552.2615(b) the District’s deadline clock is paused while a written objection and modification are pending.

    The six underlying requests cover sources used to assemble Allen ISD’s proposed library-materials lists, the Local School Library Advisory Council (LSLAC) selection process, and related internal communications. They remain open pending the District’s response to the objection.

  • Allen ISD sent a $668 cost estimate and bond demand covering six PIA requests

    The Texas Public Information Act (PIA) — Texas Government Code Chapter 552 — gives any person the right to request records held by governmental bodies, including independent school districts. On May 4, 2026, LION filed six PIA requests with Allen Independent School District covering library catalog data; the proposed 818-title library materials purchase (estimated cost, vendors, and purchase orders); library reconsideration records; library deselection and weeding records; Local School Library Advisory Council (LSLAC — the campus-level advisory body required under Texas Education Code §33.025) meeting records; and Texas Education Agency (TEA — the state agency that oversees public education in Texas) certification records. The requests are tracked as ALLENISD-PIA-003 through ALLENISD-PIA-008.

    On May 27, 2026, an itemized cost estimate covering all six requests was transmitted to LION. The aggregate estimate was $668. Production of further records was conditioned on the posting of a bond. A response window of ten business days was set.

    The $668 figure was composed of three elements: a $20 jump-drive fee for the media on which records would be delivered; 2,162 minutes of personnel labor charged at $15 per hour; and a 20 percent overhead allocation layered on top of the labor charge. The labor charge alone — roughly 36 hours at the cited rate — accounted for the majority of the estimate.

    The bond requirement was framed as a precondition to the district producing further responsive records on the six requests. Under Texas Government Code §552.263, a governmental body may, in limited circumstances, require a deposit or bond from a requestor whose anticipated charges exceed statutory thresholds. The statute also sets specific procedural requirements that must be satisfied before a bond may be demanded.

    The ten-business-day response window on the cost estimate and bond demand runs against the original May 4 records requests, which remain in clarification posture under Texas Government Code §552.222. The substantive legal response to the bond demand is documented in the next update.

  • Allen ISD’s Board of Trustees approved the 818-book List 4 on the Consent Agenda

    On May 26, 2026, the Allen Independent School District (Allen ISD) Board of Trustees approved an 818-book library purchase — known internally as “List 4” — as part of the meeting’s Consent Agenda. A Consent Agenda is a procedural device that bundles routine items into a single block motion and approves them together, without separate discussion or a separate vote on any individual item inside the bundle.

    List 4 received no separate deliberation on the record before the vote. No trustee asked the body to pull the item from the Consent Agenda for individual debate. The 818 titles — including two that had not yet been published on the date of the vote — moved through as part of the block.

    The procedural pattern — a contested library-materials list approved via Consent Agenda rather than as a standalone action item — matched the board’s October 27, 2025 vote on List 1, the first of the district’s post-Senate-Bill-13 acquisition lists. Senate Bill 13 (SB 13), enacted by the 89th Texas Legislature in 2025, rewrote Texas Education Code §33.025 to require each school district to convene a Local School Library Advisory Council (LSLAC) and to route library-material acquisitions through that council before board approval.

    The Texas Public Information Act (PIA) — Texas Government Code Chapter 552 — gives any Texas resident the right to request records from a governmental body and obligates the body to respond within statutory deadlines. LION’s PIA-001 to Allen ISD covers the records that document how the 818 titles on List 4 were selected, reviewed, and recommended.

    During the meeting’s Public Participation segment — the public-comment portion of a regular Texas school board meeting at which any resident may address the Board for up to three minutes after registering in advance — LION founder Jesse LeVasseur delivered a three-minute public comment to the Board and submitted a two-page Board Handout to the trustees and the district secretary for inclusion in the record. The handout cited the district’s own production in response to PIA-001 and itemized the documentation issues LION had identified on List 4 prior to the vote, including the two unpublished titles, the volume of acquisitions carrying no professional review on file, and the LSLAC composition question under Texas Education Code §33.025(f).

  • LION reviewed four titles from the Allen ISD List 4 proposal on the eve of the May 26 board vote

    On the eve of the May 26, 2026 Allen Independent School District Board of Trustees vote on the purchase of 818 library books for district campuses, this is a cover-to-cover review of four titles drawn from the 818-book proposal package, known internally to the district as List 4.

    Three of the four titles are published books reviewed in full from the page: Difficult Girls by Veronica Bane, Ollie In Between by Jess Callans, and Oathbound by Tracy Deonn. The fourth section covers two additional titles — Wild Blizzard by Rodman Philbrick and I Survived #26 by Lauren Tarshis — that cannot be reviewed by anyone because, on the day of the proposed vote, the books had not been published.

    Both unpublished titles appear on List 4 with proposed Elementary-shelf placement. The evidence that the district itself acknowledged the books did not yet exist comes from the district’s own production in response to LION’s first Texas Public Information Act request — reference AllenISD-PIA-001, Part 5. The Texas Public Information Act, codified at Texas Government Code Chapter 552, gives any Texas resident the right to request public records held by a governmental body. AllenISD-PIA-001 Part 5 contains the spreadsheet rows for the books proposed for purchase, with a librarian-note column attached to each title. For these two books, the librarian notes were verbatim acknowledgements of non-publication.

    For Wild Blizzard, identified by ISBN 9781546138204 with a publisher release date of October 20, 2026, the librarian note in the district’s production reads:

    “Not yet published. Set to be released October 2026.”

  • Allen ISD sent a redacted substitute PT5 and asked LION to delete the original

    On May 18, 2026 at 4:41 PM Central, J. Renee Cunningham — Communications and Marketing Specialist for Allen Independent School District (Allen ISD) — emailed LION asking that LION delete the PIR 285-050126 LION Q3-PT5 document Allen ISD had transmitted to LION earlier the same day, and substitute a redacted version in its place. The original PT5 had been delivered at 12:49 PM as part of the District’s supplemental production for Question #3 of LION reference number ALLENISD-PIA-002, a request filed under the Texas Public Information Act (PIA) — Texas Government Code Chapter 552, which gives Texas residents the right to obtain records held by governmental bodies. The District uses the prefix “PIR” (Public Information Request) on its internal request-ticket numbers.

    The recall email read in full on the operative request:

    “Please delete previously transmitted document titled PIR 285-050126 LION Q3-PT5 (only this attachment, all others are acceptable as provided) and replace with the attached PIR 285-050126 LION Q3-PT5_Redacted. The redacted document supersedes the previously provided document of the same name.”

    The recall email cited no exception under Chapter 552, identified no prior ruling from the Texas Attorney General, and supplied no OR-number (Attorney General Open Records ruling number) under Section 552.301 — the provision that requires a governmental body to seek an Attorney General decision in writing within ten business days when it wishes to withhold information from public disclosure. The single content difference between the original PT5 and the redacted substitute is one page: an inbound email from a member of the public to a trustee, dated September 18, 2025.

    LION did not delete the original document. Both versions — the original transmitted at 12:49 PM and the redacted substitute transmitted at 4:41 PM — are preserved in LION’s ALLENISD-PIA-002 production folder. LION has not filed a formal challenge to the redaction. The record stands as the District produced it.

  • Allen ISD asked LION to narrow PIA-003 through PIA-008 and consent to redactions without an Attorney General ruling

    On May 18, 2026 at 4:30 PM Central, Allen Independent School District sent LION a clarification request under Texas Government Code §552.222 — the provision of the Texas Public Information Act (Texas Government Code Chapter 552, the state law giving residents the right to request public records) that lets a governmental body ask a requestor to clarify or discuss narrowing a request. The email covered all six records requests LION filed with the district on May 4, 2026: ALLENISD-PIA-003 through ALLENISD-PIA-008.

    Each of the six requests was characterized in the district’s email as “overly broad” and “voluminous.” LION was asked to do two things: narrow each request, and consent to the district redacting material it considered confidential without seeking a ruling from the Texas Attorney General. Under Chapter 552, when a governmental body wishes to withhold information it believes is excepted from disclosure, the ordinary procedure is to request a decision from the Attorney General under §552.301. A requestor’s consent to redactions short-circuits that review.

    LION responded the same evening. For five of the six requests — ALLENISD-PIA-003, ALLENISD-PIA-004, ALLENISD-PIA-005, ALLENISD-PIA-007, and ALLENISD-PIA-008 — LION declined to narrow the request and asked the district to proceed with production. Each of those five was filed with item-by-item scoping that named record categories, date ranges, and, where applicable, specific custodians.

    A partial voluntary narrowing was offered on ALLENISD-PIA-006 alone, and only on Item 3 of that request — communications directing or recommending removal of library materials. Item 3 was narrowed to ten named library and administrative custodians and to a date floor of January 1, 2024. Items 1, 2, and 4 of PIA-006 were left as filed.

    LION declined to consent to redactions without an Attorney General ruling. The response cited the Texas Public Information Act’s procedural framework for asserting exemptions, and noted that disputed exemptions are reviewed by the Attorney General under §552.301 rather than by the governmental body acting on its own.

  • Allen ISD delivered a 495-page supplemental for PIA-002 Q3 acknowledging items were “erroneously not included”

    At 12:49 PM Central on May 18, 2026, Allen Independent School District (Allen ISD) transmitted a supplemental production to ALLENISD-PIA-002, a request LION filed on May 1, 2026 under the Texas Public Information Act (PIA) — Texas Government Code Chapter 552, which gives residents the right to request records held by Texas governmental bodies. The supplemental consisted of five PDFs (Q3-PT1 through Q3-PT5) totaling 495 pages, all responsive to question 3 of the request.

    Question 3 of PIA-002 sought records relating to the trustee sub-committee that screened applicants to the Allen ISD Local School Library Advisory Council (LSLAC) — the parent-majority panel required under Texas Education Code §33.025, enacted by Senate Bill 13 (89th Legislature, 2025), which directs school boards to appoint a local council to review library materials.

    The district’s first response to PIA-002 was transmitted on May 14, 2026 as a single 39-page PDF. The cover sheet for that response carried the line, “For the portion of the public information request highlighted below, there are no responsive documents,” followed by a list of questions that included question 3.

    The May 18 transmittal from J. Renee Cunningham, Communications & Marketing Specialist for Allen ISD, stated in writing:

    “Please note, responsive documents were received from various sources and the responsive items for question #3 of this request were erroneously not included with the submission. I incorporated the highlighted document question sheet but not the files. Attached please find the responsive documents for question #3.”

    The five attachments break down as follows: PT1 (35 pages), PT2 (22 pages), PT3 (142 pages), PT4 (146 pages), and PT5 (150 pages). Page counts were verified locally against pdfinfo. PT3, PT4, and PT5 contain DRAFT, FINAL, and REVISED FINAL versions of the September 22, 2025 board book attachments tied to the LSLAC slate approval.

    The supplemental more than doubled the production size for PIA-002, taking the combined output from 39 pages to 534 pages. It also produced records responsive to a question the district had characterized four days earlier as carrying no responsive documents.

  • LION audited the Allen ISD List 4 book-purchase proposal against the district’s own production

    On May 17, 2026, LION published its audit of the Allen Independent School District List 4 book-purchase proposal. The audit compared the proposed List 4 purchase — 818 titles set for a Board of Trustees vote on May 26, 2026 — against the district’s own production in response to the Texas Public Information Act request ALLENISD-PIA-001. The Texas Public Information Act (PIA), codified at Texas Government Code Chapter 552, gives Texas residents the right to request records held by government bodies, including school districts. List 4 is the fourth in a series of district book-purchase lists brought to the Board for approval under the Allen ISD library-materials selection policy.

    The audit drew on the district’s PIA-001 production only — approximately 775 pages across parts PT1 through PT14. No outside reviews, no third-party databases, and no external commentary were used. The findings are what the district’s own response document says — or fails to say — about the books it asked its trustees to approve.

    The findings are framed as a documentation and process failure rather than a content critique of any individual title. Three structural findings anchor that frame.

    Roughly forty-five percent of List 4 carried no third-party basis in the district’s own response. Across the Elementary and Middle School portions of the production — where the entries are clean enough to count without optical-character-recognition uncertainty — at least 368 of the 818 books showed no professional review citation, no state-list citation (Bluebonnet, Tayshas, Lone Star, Topaz, Tejas, Maverick, 2×2), and no award citation (Caldecott, Newbery, Coretta Scott King, Pura Belpé, Sibert, Printz, Orbis Pictus, Batchelder, Junior Library Guild) anywhere in the entry block. With the Lowery Freshman Center and Allen High School campuses added in, the share rises further; the forty-five percent figure is the conservative floor the district’s own pages support.

    District-authored notes and publisher marketing copy together accounted for more source-label cells than the district’s own stated professional-review sources combined. Source-label cells were tallied across the Elementary, Middle School, Lowery Freshman Center, and Allen High School sections of the production. Librarian Note — district-authored prose — was the single most frequent source label, appearing on 262 cells (37 percent). From the Publisher — vendor marketing copy — appeared on 160 cells (23 percent). When the From Follett vendor-supplied entries (46 cells) are added, district-authored notes plus vendor-supplied copy reached 468 source-label cells. The district’s own stated professional-review sources — Booklist, Bulletin of the Center for Children’s Books, Hornbook, Library Journal, Publishers Weekly, School Library Journal — together accounted for 482 cells across the same sections, a roughly even split. Within that professional category, Booklist alone carried 255 cells (36 percent), Publishers Weekly 86, School Library Journal 55, Horn Book 38, Kirkus 2, and Bulletin of the Center for Children’s Books zero.

    One entry on List 4 contradicted itself across two parts of the same production. Suzanne Collins’s Hunger Games prequel Sunrise on the Reaping (ISBN 9781546171478) appeared in the Middle School section with roughly 200 words of School Library Journal review text and roughly 200 words of Publishers Weekly review text reproduced verbatim. The same physical ISBN appeared in the Lowery Freshman Center section with a Librarian Note declaring “No reviews; approved list 1.” The reviews demonstrably existed; the LFC entry’s claim that they did not was, on the face of the district’s own response document, false.

    The framing — documentation broken in the district’s own record — supports a vote-to-defer or vote-to-table motion at the May 26 meeting and a follow-on PIA sequence rather than any claim about specific book content.

  • Allen ISD delivered the first ALLENISD-PIA-002 response, marking two questions “no responsive documents”

    On May 14, 2026, Allen Independent School District (Allen ISD) delivered the first response to ALLENISD-PIA-002, the records request LION filed seeking documentation of the trustee sub-committee that selected the district’s Local School Library Advisory Council (LSLAC). The request was logged by the district as PIR 285-050126. The Local School Library Advisory Council is the parent-and-community panel required of every Texas school district under Texas Education Code §33.025, enacted by Senate Bill 13 (2025), to review and recommend library materials for the district’s campus collections.

    The Texas Public Information Act (PIA) — Texas Government Code Chapter 552 — gives Texas residents the right to request public records from a governmental body and obligates the body to respond within statutory deadlines. ALLENISD-PIA-002 asked for six discrete categories of records tied to the LSLAC selection: the names of the sub-committee members, the date of their meeting, any Texas Open Meetings Act (TOMA) posted notice for that meeting, any scoring sheets or evaluation notes used to rank applicants, the applications themselves, and trustee-and-staff communications about the selection process between July 1 and September 22, 2025.

    The May 14 production was 39 pages. Records were produced for the questions covering sub-committee membership, meeting date, the 82 applications received, and the narrowly read communications category. Two questions were marked “no responsive documents”:

    • Q3 — any TOMA-compliant public notice posted for the September 5, 2025 LSLAC sub-committee meeting.
    • Q4 — any scoring sheets, ranking matrices, evaluation forms, ballots, or written notes generated by the sub-committee in the course of selecting the LSLAC from the 82 applicants.

    Four days later, on May 18, 2026, the district delivered a supplemental production labeled Q3 (files PT1 through PT5), totaling 495 pages, under the same PIR number (PIR 285-050126). That supplemental production is documented in a separate update.

    LION founder Jesse LeVasseur said the first-response markings on Q3 and Q4 are the facts to record at this stage. The audit of what the 39 pages do and do not establish, and what the May 18 supplemental added or walked back, is documented separately in LION’s working file for Allen ISD.
